<p>I usually try to stay current in my posts but alas, life invariably manages to intervene. Latest case in point: the now all-too-well-known <a title="WaPo 4/1/11" href="http://www.washingtonpost.com/opinions/reconsidering-the-goldstone-report-on-israel-and-war-crimes/2011/04/01/AFg111JC_story.html" target="_blank">Goldstone Washington Post, op-ed</a>, which came out just as I was leaving to take my son on an extended college visit road trip. So even though this story is yesterday&#8217;s news by blogosphere standards, I&#8217;d like to weigh in with a few thoughts, belated though they may be:</p>
<p>Many are asking why Judge Richard Goldstone chose to &#8220;reconsider&#8221; <a href="http://shalomrav.files.wordpress.com/2011/04/a-hrc-12-48-11.pdf">his committee&#8217;s report</a> nearly two years after it was presented to the UN Human Rights Council. In fact, Goldstone himself answers this question in the second paragraph of the op-ed: it was written in reaction to the recent release of <a href="http://shalomrav.files.wordpress.com/2011/04/a-hrc-16-24_auv.pdf">a report by a UN commitee of experts</a> — chaired  by former New York judge Mary McGowan Davis — that followed up on the  recommendations of the Goldstone Report.</p>
<p>But of course for most, it&#8217;s not quite that straightforward. <a title="Forward 4/6/11" href="http://www.forward.com/articles/136818/" target="_blank">Many have speculated</a> that the somewhat conciliatory tone of the op-ed indicates that Goldstone, a lifelong Zionist, may be trying to make amends with Israel and the Jewish community. Indeed, the blogosphere has been positively rife with theories that explain the psychological rationale for Goldstone&#8217;s public &#8220;reconsideration.&#8221;</p>
<p>While interesting, this kind of speculation is ultimately fairly moot. Richard Goldstone himself has never been the issue here. What truly matters are the serious allegations his committee made regarding the events that took place during Operation Cast Lead in 2008-2009. And now: whether or not the new McGowan Davis Report has caused Goldstone to fundamentally recant these allegations.</p>
<p>In his op-ed, Goldstone found it significant that the McGowan Davis Report reported &#8220;Israel has dedicated significant resources to investigate over 400 allegations of operational misconduct in Gaza.&#8221; In particular, Goldstone felt this shed some light on the issue of &#8220;intentionality&#8221; &#8211; which many found to be the most damning finding of the Goldstone Report.</p>
<p>As Goldstone wrote in his op-ed:</p>
<blockquote><p>While the investigations published by the Israeli military and  recognized in the (McGowan Davis) report have established the validity  of some incidents that we investigated in cases involving individual  soldiers, they also indicate that civilians were not intentionally  targeted as a matter of policy.</p></blockquote>
<p>Goldstone went on to say that if Israel had cooperated with his commission during its initial investigation, he would have been able to clarify further the critical issue of whether the IDF intentionally targeted civilians or whether these were isolated incidents perpetrated by individual soldiers.</p>
<p>While this may well be true, the issue of intentionality is by no means resolved. In fact, the McGowan Davis Report makes it clear that it cannot determine whether or not civilians were intentionally targeted as a matter of policy until Israel carries out a properly independent and transparent (i.e., non-military) investigation.</p>
<p>From p. 12 of the McGowan Davis Report:</p>
<blockquote><p>Therefore, the Committee remains of the view that an independent public commission – and not the (Israeli Military Advocate General&#8217;s) office – is the appropriate mechanism for carrying out an independent and impartial analysis, as called for in (the Goldstone Report), into allegations that high-level decision-making related to the Gaza conflict violated international law.</p></blockquote>
<p>At any rate, the issue of intentionality is but one of the many disturbing allegations brought to light by the Goldstone Report. In <a title="WaPo 4/5/11" href="http://www.washingtonpost.com/opinions/beyond-goldstone-a-truer-discussion-about-israel-hamas-and-the-gaza-conflict/2011/04/05/AFsP7PlC_story.html" target="_blank">a Washington Post op-ed</a> yesterday, Jessica Montell, Director of <a title="B'tselem" href="http://www.btselem.org/English/index.asp" target="_blank">B&#8217;tselem</a>, correctly pointed out that even if Israel did not intentionally target civilians, there are any number of troubling allegations regarding the IDF&#8217;s behavior during Operation Cast Lead:</p>
<blockquote><p>In the operation, according to <a href="http://www.btselem.org/english/statistics/casualties.asp?sD=27&amp;sM=12&amp;sY=2008&amp;eD=18&amp;eM=01&amp;eY=2009&amp;filterby=event&amp;oferet_stat=during">rigorous research by B’Tselem</a>,  Israel killed at least 758 Palestinian civilians who did not take part  in the hostilities; 318 of them were minors. More than 5,300  Palestinians were injured, over 350 of them seriously. More than 3,500  houses were destroyed, and electricity, water and sewage infrastructure  was severely damaged. In many ways, the Gaza Strip has yet to recover  from the unprecedented destruction this operation wrought.</p>
<p>The  extent of the harm to civilians does not prove that Israel violated the  law. But Israel has yet to adequately address many allegations regarding  its conduct, including: the levels of force authorized; the use of  white phosphorous and inherently inaccurate mortar shells in densely  populated areas; the determination that government office buildings were  legitimate military targets; the obstruction of and harm to ambulances.</p></blockquote>
<p>In <a title="AP 4/6/11" href="http://news.yahoo.com/s/ap/20110406/ap_on_re_mi_ea/ml_israel_un_report_5" target="_blank">his only interview since his op-ed</a>, Goldstone has stated he has &#8220;no reason to believe any part of the report needs to be reconsidered at this time.&#8221; Two other members of his original commission, <a title="Middle East Monitor 4/4/11" href="http://www.middleeastmonitor.org.uk/resources/interviews/2207-member-of-un-fact-finding-mission-on-gaza-conflict-insists-report-stands-unchanged" target="_blank">Hina Jilani</a> and <a title="Ha'aretz 4/4/11" href="http://www.haaretz.com/news/diplomacy-defense/un-council-goldstone-regret-not-enough-to-rescind-gaza-war-report-1.354070" target="_blank">Desmond Travers</a> have both stated that they fully stand behind their findings as well.</p>
<p>However you choose to characterize Goldstone&#8217;s recent words, it is clear that he has not in any way recanted his commission&#8217;s report. Indeed, the fury with which Israeli politicians first received the Goldstone Report &#8211; and <a title="JTA 4/3/11" href="http://jta.org/news/article/2011/04/02/3086679/goldstone-i-was-wrong-on-israels-intentions">their vociferous insistence that it now be formally withdrawn</a> &#8211; is the surest sign of its continuing moral power &#8211; and of the continuing need for Israel to conduct an independent, credible and transparent investigation of its actions during Cast Lead.</p>
<p>This was, after all, the most important recommendation of the Goldstone Report &#8211; and why, in my opinion, it still remains as relevant as ever.</p>

<p>As the sun went down on Friday night, we gather in the venerated shrine of Ali Ibn Hamzeh (above and below). The inside of the mosque is inlaid with countless small mirrored tiles that reflect fragments of light, movement and the faces of everyone inside. As a young boy intones &#8220;Allah Hu Akhbar!&#8221; over the loudspeaker, worshippers file in, kneel and begin to pray. Even though it&#8217;s not my prayer tradition, even though I&#8217;m merely a guest, I&#8217;m palpably aware that I&#8217;m dwelling in sacred space and sacred time. I&#8217;m also also all too mindful that our journey through Iran is fast coming to a close.</p>
<p class="MsoNormal" style="margin:0 0 10pt;"><img class="aligncenter size-full wp-image-2456" title="iran8-003" src="http://shalomrav.files.wordpress.com/2008/12/iran8-003.jpg?w=500" alt="iran8-003"   /></p>
<p>Earlier in the day, we visited with the leaders of the Shiraz Jewish community. It&#8217;s obviously a smaller community than the Jewish community of Tehran, but it&#8217;s vital and active nonetheless.  We learned that there are approximately 6,000 Jews in Shiraz and that their presence here dates all the way back to Cyrus the Great. The current Shiraz Jewish Community Center was founded 70 years ago ; there are 17 active synagogues and though there is no rabbi specifically the city, the community has been trained to take care of all of its essential religious needs. (Below: me and Moshe, who speaks fluent Hebrew and serves as an important religious resource for Shirazi Jews).</p>
<p><img class="aligncenter size-full wp-image-2458" title="iran8-002" src="http://shalomrav.files.wordpress.com/2008/12/iran8-002.jpg?w=500" alt="iran8-002"   /><br />
Like the Jewish leaders of Tehran, the Jews of Shiraz reminded us that they consider themselves to be <em>Iranian</em> Jews. I am beginning to understand why they feel this way. After all, for most of Jewish history, Jews have wandered from place to place throughout the world &#8211; but Jews have lived here in Iran literally for over 3,000 years. It is their home in a way that most of Jews can only barely begin to understand, and it is clear that they have a deep and sacred bond to Persian culture, land and  heritage.</p>
<p>We had a fairly lively dialogue and we appreciated that they were as interested in learning about us as we were about them. We discussed in particular the differences between living as Jews in a religious nation and living in a country that separates church and state.  They articulate a strong appreciation for living in a country where the Supreme Leader is a religious leader and where religious values are central to the life of their nation. And like the Jews of Tehran, they insist that they enjoy religious freedom in their country and are perfectly comfortable living as Jews in an Islamic state.</p>
<p>It was a warm and fruitful exchange, and when we ended they expressed a very strong desire to have a deep and substantive relationship with American Jews. For our part, the Jews of this delegation share this desire and are already thinking of ways we can build upon the connections we have created here. <p>I kid you not. The mighty Rena Glickman (known to millions of judo-devotees as Rusty Kanokogi) has been doing her thing since the 1950s, when she had to masquerade as a man to practice her art (a neo-Yentl saga if ever there was one!) <a title="Sports Illustrated 11/24/08" href="http://vault.sportsillustrated.cnn.com/vault/article/magazine/MAG1148857/index.htm" target="_blank">A recent Sports Illustrated</a> article gives the backstory:</p>
<blockquote><p>(Kanokogi) had to collect 25,000 signatures and threaten legal action for sex discrimination against the International Olympic Committee and its TV partner, ABC, to get women&#8217;s judo into the Games in &#8217;88&#8230;She also found time, in between, to coach the 1988 Olympic team, officiate the &#8217;96 Olympics and provide NBC&#8217;s color commentary at the 2004 Games.</p></blockquote>
<p>I was so sorry to read that Ms. Kanokogi is currently being treated for bone cancer &#8211; all the more reason to be proud that she is receiving this unprecedented honor. Mazel Tov Rusty! (Or as the judo masters teach: <em>&#8220;Chiri mo tsumori yamato nari.&#8221;)</em></p>

<blockquote><p>Rabbi Akiva says: &#8220;&#8216;Love your fellow as yourself&#8217;&#8221; (Leviticus 19:18), is the greatest principle of the Torah.</p>
<p>Ben Azzai says, &#8220;&#8216;When God created man, He made him in the likeness of God&#8217; (Genesis 5:1) is the greatest principle in the Torah. You should not say: Because I have been dishonored, let my fellow be dishonored along with me…&#8221;</p>
<p>Rabbi Tanhuma explained: &#8220;If you do so, know whom you are dishonoring – &#8216;He made him in the likeness of God.&#8217;&#8221; (Genesis Rabbah 24)</p></blockquote>
<p>In this classic Midrash, Rabbis Akiba and Ben Azzai are doing what Talmudic rabbis do best: playing a lively game of spiritual oneupsmanship. In this case, they are debating the central value of Torah: according to Akiba it is the famous verse from Leviticus, &#8220;Love your neighbor as yourself.&#8221; Ben Azzai counters with the insight from this week&#8217;s Torah portion: humanity was created in God&#8217;s image.</p>
<p>Rabbi Tanhuma&#8217;s final statement reinforces the weakness of Akiba&#8217;s claim: though it is certainly praiseworthy to love your fellow as yourself, this might imply that you only need to treat your fellow as well (or as badly) as you yourself are treated. Ben Azzai points out that if we truly understand that all people are made in the image of God, we must accept that any time we shame, insult or abuse another, we do the same to God.</p>
<p>I am particularly struck that Akiba&#8217;s statement expresses an essentially humanist point of view, while Ben Azzai&#8217;s is an inherently theological assertion. In a sense, Ben Azzai raises the moral stakes of the equation. As the saying (<a title="&quot;Dostoevsky Didn't Say It&quot;" href="http://www.infidels.org/library/modern/features/2000/cortesi1.html" target="_blank">often misattributed to Dostoevsky</a>) goes: &#8220;where there is no God, all is permitted.&#8221; This drives home the radical imperative in Genesis: if all people are made in the divine image, all people are of infinite worth; all people are deserving of dignity, respect and fair treatment.</p>
<p>The Torah thus begins with this foundational principle, which has both interpersonal/ethical as well as global/moral implications. As we start Torah anew yet again, we return to its central question: how can we find the wherewithal to treat <em>everyone</em> we meet as a fellow child of God? How can we, as Americans, as Jews, as global citizens find dignity and respect for all who dwell on earth?</p>

American Conference on Judaism and Human Rights" href="http://www.rhr-na.org/story/registration-is-now-open-for-the-second-north-american-conf" target="_blank">the Second North American Conference on Judaism and Human Rights </a>on December 7-9 in Washington DC.</p>

			<content:encoded><![CDATA[<p><img src="http://shalomrav.files.wordpress.com/2007/10/cake1.jpg?w=100&#038;h=100" alt="cake1.jpg" align="right" border="0" height="100" width="100" />That&#8217;s right, it was just one year ago today that I launched this venerable blog. Who knew I&#8217;d be enjoying this so much?</p>
<p>When I orginally began Shalom Rav I hoped, as I wrote in my first post, that it would have &#8220;something to contribute.&#8221; I also hoped it would serve as a way to stay connected with my congregants during a year when JRC was living in temporary quarters throughout the Chicago diaspora.  What I didn&#8217;t fully expect was the extent to which I would be connected with so many souls throughout the greater blogosphere. Though I had no idea of what to expect when I began, I am now a true believer in the power of blogs to connect people, share ideas, and create worthwhile conversations/debates.</p>
<p>As far as the hard stats go, in this past year, Shalom Rav has to date logged 50,943 visits, 171 posts, 366 comments (and a spam count of 2,399).  Heartfelt thanks to all those who&#8217;ve dropped in for a visit &#8211; and special gratitude to all of you who took the time to weigh in with your thoughts and responses. Please keep &#8216;em coming&#8230;</p>
