Is the FBI Criminalizing Curiosity About Israel/Palestine?

This past summer, Sara Smith, a young Jewish woman from Chicago, visited Israel/Palestine with two Palestinian-American friends. Sarah had never been and was interested in seeing for herself what life was like for Israelis and Palestinians. As she would later put it, “I went there so I could make up my own mind and talk about what I saw.”

On Friday, December 3, Sarah received a phone call from an FBI agent, who asked her if she could come in to answer some questions. When she asked what this was about, he said he “was not at liberty to discuss it.” She asked if she would need a lawyer present; the agent said it was up to her but that she was not in any trouble and that they just wanted to ask her a few questions.

Understandably alarmed, Sarah told the agent that she wanted to consult a lawyer and get back to him. She repeated that it would be easier for her if she knew what this was all about. He replied that it had to deal with the trip she had taken over the summer, adding ominously, “I think you know which one I’m talking about.”

Sarah later learned from her lawyer that she, along with her two friends, were being subpoenaed to appear before a grand jury.

Lest you think that Sara might be an undercover Hamas operative or a naive young radical, let’s let her father introduce her to you:

I don’t think I need to speak in defense of her character. While she was in high school, Crain’s Chicago Business had a special edition called the “100 Most Influential Women in Chicago” and they chose my daughter as being one of Chicago’s six most influential and up-and-coming women high school students. Crain’s Chicago Business chose her partly because they saw she was willing to travel to different parts of the world and see for herself and to make up her own mind about what was happening over there. Evidently, the FBI thinks that there is something criminal in doing that.

I myself have done similar trips as Sara more than once. So have many of my friends and colleagues. This Sunday, I’m going to leave with 20 members of my congregation to visit Israel/Palestine so we can, yes, learn about “what life is like for Israelis and Palestinians.” (More on that very soon.) Is this now standard operating procedure in our country: visit Israel/Palestine to get a real look at the conflict, expect a subpoena from the FBI?

If this all sounds sadly familiar, you might remember that back on September 24, the FBI raided the homes of anti-war activists in Minnesota, Chicago and Michigan and issued subpoenas to 14 of them. To date, they have all refused to testify and US Attorney Patrick Fitzgerald has since withdrawn the summons. However, he recently reissued subpoenas to three Minnesota women who are facing “indeterminate imprisonment” if they continue refusing to testify.

It’s beyond egregious. Back in September, it looked like freedom of dissent was now a potentially punishable crime. This definition of “crime” has now apparently been extended to include honest curiosity about the world around us.

Jews and Arabs in Israel: What Would You Call It?

I’m fairly sure that if I used the word “apartheid,” to describe the socio-political reality in Israel/Palestine, I’d be tarred and feathered six ways to Sunday by the American Jewish establishment.

Meanwhile, some truth-tellers in the Israeli press are openly using the “a-word” because, well, because it’s just becoming impossible to ignore what’s really going on in their country.

From an October 29 article in Ha’aretz, “Segregation of Jews and Arabs in 2010 Israel is Almost Absolute:”

Under the guise of the deceptively mundane name “Amendment to the Cooperative Associations Bill,” the Knesset’s Constitution, Law and Justice Committee this week finalized a bill intended to bypass previous rulings of the High Court of Justice. If indeed this legislation is approved by the Knesset plenum, it will not be possible to describe it as anything other than an apartheid law.

And from today’s Ha’aretz, “South Africa is Already Here:”

Israel’s apartheid movement is coming out of the woodwork and is taking on a formal, legal shape. It is moving from voluntary apartheid, which hides its ugliness through justifications of “cultural differences” and “historic neglect” which only requires a little funding and a couple of more sewage pipes to make everything right – to a purposeful, open, obligatory apartheid, which no longer requires any justification.

OK, forget the a-word, forget the loyalty oath and the “Amendment to the Cooperative Associations Bill.” Just read this report by Adalah: Legal Center for Arab Minority Rights in Israel and come up with your own word for it.

The Sorrows of Jewish Ethnonationalism

Israel is going down a very dark road.

From a recent article in The Economist:

Not long ago, Lod, an Israeli city near the commercial hub of Tel Aviv, was a sleepy backwater. Its 20,000 Arabs among 45,000 Jews peppered their Arabic with Hebraisms, voted for Jewish parties, and described themselves as Israeli. The Arab population, drastically reduced in the 1948 war that marked Israel’s birth, has revived, exceeding its previous total.

But the calm has been disturbed. This month Israel’s leaders have taken their demand that the world—and the Palestinians—should recognise their state as specifically Jewish in exchange for a renewed freeze on building Jewish settlements in the West Bank, to Lod. Cabinet members have proposed “strengthening” the city’s population by bringing in more Jews and have approved a wider bill requiring new citizens to swear a loyalty oath accepting Israel as Jewish and democratic—in that order. Other measures are aimed at Israel’s Arabs, including a ban on teaching the Palestinian narrative that Israel expelled most of its Arabs in the war of independence.

Liberal Israelis fear that these measures may import the Arab-Israeli conflict, which had been largely confined to the territories occupied by Israel beyond the 1948 partition line, into Israel proper. Adding to the psychological barriers, the Lod authorities have erected physical ones. This year they have finished building a wall three metres high to separate Lod’s Jewish districts from its Arab ones. And where the Arab suburbs are cordoned off to prevent their spread, Israel’s prime minister, Binyamin Netanyahu, encourages building for Jews to proceed with abandon.

His foreign minister, Avigdor Lieberman, on the coalition’s far right, champions building quarters for soldiers’ families in the town. The equally chauvinistic interior minister, Eli Yishai, who heads an ultra-Orthodox party, Shas, grants building permits for religious Jews. A series of gated estates are sprouting across the city reserved for religious Zionists. “These blocks will ensure Lod stays Jewish,” says Haim Haddad, the town’s chief rabbi, one of the first to move into a new estate.

By contrast, old Arab houses are under threat of demolition. Now and again, bulldozers demolish a couple, stressing Arab vulnerability. A study by a liberal Israeli group called Shatil (“Seedling”) estimates that 70% of Arab homes in Lod lack legal status. Many municipal services, such as street lighting and rubbish collection, stop at the boundaries of Arab suburbs. Sixteen kilometres (ten miles) from Tel Aviv, Israel’s richest city, sewage flows through some of Lod’s Arab streets.

And this from a recent article in Ha’aretz:

The Knesset’s Constitution, Law and Justice Committee on Wednesday unanimously approved a bill which gives the right to absorption committees of small communities in Israel to reject candidates if they do not meet specific criteria.

The bill has sparked wide condemnation and many believe it to be discriminatory and racist, since it allows communities to reject residents if they do no meet the criteria of “suitability to the community’s fundamental outlook”, which in effect enables them to reject candidates based on sex, religion, and socioeconomic status.

The bill is due to be presented before the Knesset plenum in the coming weeks.

Israeli Arab MKs were outraged by the proposal and walked out on the committee’s discussion of it.

MK Talab al-Sana (United Arab List – Ta’al) called the bill racist and said it was meant to prevent Arabs from joining Israeli towns. MK Ahmed Tibi (United Arab List – Ta’al) compared the bill to racist laws in Europe during World War Two, and the two told the committee members before leaving the hall: “We will not cooperate with this criminal law – you have crossed the line.”

The committee’s chairman, David Rotem (Yisrael Beiteinu), responded to claims the bill was meant to reject Arabs from joining Israeli towns. “In my opinion, every Jewish town needs at least one Arab. What would happen if my refrigerator stopped working on a Saturday?”

Another Palestinian Gandhi Sent to Prison

We’ve often heard asked “where are the Palestinian Gandhis?”  The answer?  Too many of them are sitting in Israeli prisons.

Exhibit A: Abdallah Abu Rahmah, a leader of the nonviolent campaign in the West Bank village of  Bil’in, who was arrested last year by soldiers who raided his home at the middle of the night. An Israeli military court exonerated him on charges of stone-throwing and arms possession (the “arms” turned out to be empty bullet casings and tear gas canisters that Abu Rahmah had collected to prove IDF violence against demonstrators) but he was eventually convicted of “organizing illegal demonstrations” and “incitement.”

Here’s how Israeli activist Jonathan Pollak characterized these events last year:

On a pitch black early December night, seven armored Israeli military jeeps pulled into the driveway of a home in the West Bank town of Ramallah. Dozens of soldiers, armed and possibly very scared, came to arrest someone they were probably told was a dangerous, wanted man – Abdallah Abu Rahmah, a high school teacher at the Latin Patriarchate School and a well-known grassroots organizer in the village of Bil’in.

Every Friday, for the past five years, Abdallah Abu Rahmah has led men, women and children from Bil’in, carrying signs and Palestinian flags, along with their Israeli and international supporters, in civil disobedience and protest marches against the seizure of sixty percent of the village’s land for Israel’s construction of its wall and settlements. Bil’in has become a symbol of civilian resistance to Israel’s occupation for Palestinians and international grassroots.

Abu Rahmah was taken from his bed, his hands bound with tight zip tie cuffs whose marks were still visible a week later, and his eyes blindfolded. A few hours later, as President Obama spoke of “the men and women around the world who have been jailed and beaten in the pursuit of justice” upon receiving the Nobel Peace Prize, Abu Rahmah’s blindfold was removed as he found himself in a military detention center. He was being interrogated about the crime of organizing demonstrations. In occupied Palestinian territories, Abu Rahmah’s case is not unusual – about 8,000 Palestinians currently inhabit Israeli jails on political grounds.

Abu Rahmah’s sentence came down today: one year in prison, a six months suspended sentence for three years, and a fine of 5,000 shekels. The military prosecution is expected to appeal, which means he is likely to remain in jail indefinitely.  Another Bil’in activist, Adeeb Abu Rahmah, was also sentenced for twelve months on similar charges but still remains in prison after fifteen months while prosecutors continue to appeal his conviction.

Protest the FBI Raids – Support Freedom of Dissent in post 9/11 America!

On September 24, the FBI raided eight homes and offices of antiwar activists in Chicago and Minneapolis and subsequently issued a summons for them to appear before a grand jury in Chicago.  I won’t go into the details of this egregious violation of the Constitutional rights of US citizens because this Democracy Now piece (part one above, part two, below) does a thorough job in covering all the sordid details. If you live in the Chicago area (and are outraged at the increasing criminalization of dissent in post 9/11 America), I encourage you to attend a rally to against the raids and support of the peace activists subpoenaed by the FBI on Tuesday, October 5 at 8:30 am outside the Dirksen Federal Building, 230 S. Dearborn Avenue, Chicago.

We are people of faith and conscience who condemn the recent FBI raids in Chicago as a violation of the constitutional rights of the people and organizations raided. They are a dangerous step to further criminalize dissent. The FBI raids chisel away and bypass fundamental constitutional rights by hauling activists before grand juries under the guise of national security. An overly broad definition of “material support for terrorism” in the June 2010 US Supreme Court ruling concerns us as people of faith who continue to be actively engaged in humanitarian work and peacemaking.

The real illegitimate activities are U.S. foreign policies that support war and occupation. We believe that peacemaking is a sacred commandment.  We feel compelled to work to end military solutions that kill and maim innocent people, destroy civil society institutions, create massive poverty and dislocation of people from their homelands, militarize our own nation and continue to create more animosity against the United States, thus undermining our security.

We are committed to a just peace in Israel and Palestine, Iraq, Afghanistan and Colombia. Some of us have visited these conflicted areas and accompanied those most affected by the violence. Some of us have permanent staff and volunteers working nonviolently for a peaceful resolution to these conflicts. We all stand opposed to the United States’ and all nations’ support of military aid and military intervention in these countries. The infusion of military aid has exacerbated violence rather than resolved it.

We believe in a divine spirit of justice and hope that promotes understanding and equality of all humanity. We refuse to remain silent in the face of the latest efforts of the FBI to chill dissent against war by invading homes of peace activists and calling a grand jury with sweeping powers to manufacture fear. We denounce the use of fear and the far-reaching labeling of critical dissent as “terrorism” that tramples on not only our right, but our duty to dissent as people called to a moral standard of justice for all.

Jews, Power and Privilege: A Sermon for Yom Kippur 5771

From my Yom Kippur sermon yesterday:

For matter how painful the prospect, I don’t think we can afford to dodge this question. If we agree that the inequitable distribution of power and privilege is a critical problem for us and for our world, then there will inevitably be times in which we are faced with an intensely difficult question: does tribal loyalty trump solidarity with the oppressed?

Actually, I’m coming to believe that this is not the best way to frame the question. I don’t really think it’s all that helpful to view this issue as some kind of zero-sum game; to see it as a question of tribal allegiance; to insist that I either stand with my own people or I don’t. I prefer to say it this way: that it is in my self interest as a Jew to stand in solidarity with the oppressed because I believe that Jews cannot be fully human while they benefit from a system that denies others their own humanity. For those with power and privilege, the struggle against racism and oppression is fought knowing that our own liberation is also at stake.

The Supreme Sacrifice: A Sermon for Erev Yom Kippur 5771

From my Erev Yom Kippur sermon last Friday:

And as I think about it, perhaps this is why we read a Martyrology on Yom Kippur. As we remember our martyrs, we search our own souls and ask ourselves honestly: what have we done in the past year to prove ourselves worthy of these profound sacrifices? What have we done to affirm that these people did not die in vain? Did we indeed honor their memories by transforming loss into justice and hope for our world?

Confronting Islamophobia: A Sermon for Rosh Hashanah 5771

From my Rosh Hashanah sermon last Thursday:

So what is the real issue here?  I don’t think it’s about sensitivity to individuals who may or may not be offended by this particular construction project. The real issue is really quite straightforward. The real issue, I believe, is the same as it ever was – and as Jews, it’s an issue we know all too well. Will America be a land of religious liberty for all or merely the few?

Israel Levels a Bedouin Village – Add Your Voice of Protest

On July 27, an Israeli police force of 1,500 evicted over 300 Bedouin Israeli citizens – mostly children – from the village of Al-Arakib in the Negev, leaving them homeless, expelled from their land, and bereft of their possessions. Bulldozers from the Israel Lands Administration then proceeded to demolish their homes, sheep pens, fruit orchards and olive tree groves, so that the Jewish National Fund can plant a forest on their land.

From an Adalah press release:

Residents of the Arab Bedouin unrecognized village al-Araqib in the Naqab (Negev) in the south of Israel were woken up at dawn on 27 July 2010 to find themselves surrounded by police officers, some of them on horseback. The police declared the village to be a “closed area”, and warned residents that any attempt to resist their orders would lead to their forced evacuation. The police ordered the residents to leave their homes in two minutes. The residents tried to take their belongings from their houses, but the police did not wait and began to immediately demolish their homes. No less than 1,300 police officers, accompanied by the Green Patrol, a unit within the Nature Reserves and Parks Authority that often harass the Arab Bedouin, took part in the brutal destruction of the village. Throughout the demolition operation, a helicopter flew above the village. When the demolition ended, all 45 houses of the houses were razed to the ground and its 250 residents – men, women, elderly people and children, were left without a roof over their heads and all of their belongings confiscated.

In violation of law, most police officers who took part in the raid covered their faces and did not wear identity tags. They had weapons, tear gas, truncheons and other arms. Apparently in this way, the police officers sought to prevent the residents from identifying them. T-he residents did not respond violently to the destruction.

One of the most shocking aspects of the raid was that a bus filled with dozens of radical right-wing Jewish youth accompanied the police to the village. The youth began to tease the Arab Bedouin residents, who are citizens of Israel and who just lost their homes, and applauded when the police officers demolished the homes. This conduct amounts to vigilantism, a punishment outside of the law.

During the operation of destruction, the police confiscated all personal possessions of the residents from their homes including refrigerators, ovens, closets, bedroom and dining room furniture, textiles, carpets, crafts, etc. They also took other property from the area surrounding the houses such as electricity generators, plows, flour bags and the like.

Representatives of the Tax Authority also accompanied the police and seized property of residents in debt to the tax authorities. This confiscation was undertaken without prior warning or demand from the residents to pay their debt, and therefore, it too was illegal. Residents were required to pay NIS 22,500 (almost US $6,000) to retrieve their property.

One final encouragement if you are a member of the Jewish community: while this action is clearly a violation of international human rights, it is also of critical importance to Jews, who are implicated in all actions taken by the Jewish state. Please sign and pass on this petition which is being disseminated by the Jewish Alliance for Change. The campaign hopes to add American Jewish voices to a growing Israeli petition, which will be hand delivered to the Prime Minister’s Office in Jerusalem on August 10.
